SEPTEMBER 20, 2016 PLANNING & ZONING
The meeting was called to order at 6:00 p.m. by Chairman Steve Kossett. Present for the meeting were Chairman Kossett, Commission Members Kathy Meyer, Biron Wipson, Pete Branca, Bob Whitmyer, and Katie Vukelich, Zoning Administrator Teresa Koivula, Deputy Clerk Toni Blomdahl, Councilor Suzanne Herstad, John Klaers from Klaers and Associates, and guests Greg Andrews, Bob Quade, and John Goman.
Kathy made a motion to approve the August 11, 2016 Ordinance #42 meeting minutes with a second by Katie. All vote in favor. Motion carried. Bob made a motion to approve the August 11, 2016 Ordinance #34 meeting minutes with a second by Biron. All vote in favor. Motion carried. Kathy made a motion to approve the August 16, 2016 meeting minutes with a second by Bob. All vote in favor. Motion carried.
BUSINESS FROM THE FLOOR: None
Ordinance #42: Teresa stated City Council approved the commission’s recommendation to adopt Ordinance #42 at the last council meeting.
Ordinance #34: Teresa stated City Council approved Option B for changes to Ordinance #34 at the last council meeting. John Goman stated the council would like just one document for their approval going forward. Greg stated the public hearing is a working meeting and we can make changes at that hearing. Steve stated discussion should be held on any proposed changes during the public testimony portion of the hearing.
Conditional Use Permit Inspections: Teresa stated the CUP Synopsis is in the commission’s packet. Teresa stated there has been progress on these inspections over the last few years and noted we inspected 27 properties and only 6 needed follow ups.
New Business: Teresa asked if she could add new business to the agenda for the new City Council Liaison. Bob made a motion to accept the change to the agenda with a second by Biron. All vote in favor and the item was added to the agenda.
City Council Liaison: Teresa stated City Council has assigned a liaison for the planning commission and introduced City Councilor Suzanne Herstad to the commission.
Meeting with Bridget Brine: Teresa stated we had a meeting with Bridget Brine, attorney for a developer regarding a proposed development in the city and showed the commission some concept drawings. Teresa stated it may be a major subdivision and/or a rezone and noted she discussed access and lighting with Bridget and whether to treat this as a Planned Unit Development(PUD) or a commercial development. Bob stated he would like to see the access off Martin Road line up with the access to Sunset on the north side of Martin Road. John Klaers stated normally you would line up the driveways so it looks like an intersection and that the density can increase when there is city sewer and water. Teresa stated the development is just in the beginning stages so nothing has been finalized yet.
Ordinance #22- Commercial: Teresa noted she included in the commission’s packet some information on commercial zoning in the neighboring communities. Teresa stated, with the developments coming in the area, we need to look at our lot coverage for commercial zoned property. Teresa stated our current 30% lot coverage makes it difficult to attract businesses to the area as well as limiting the economic potential for developers and the city. John Goman stated we have designated commercial zoned areas for development to provide services to the community and residential zoned districts which are more rural in nature. Teresa stated on commercial properties adjacent to residential properties, she would like to see a buffer to protect the residents from commercial noise, lights, etc. John Klaers stated when looking at a property you usually take out the side, rear, and front yard setbacks and this is considered your buildable area, then you address lot coverage and determine what you can put on that buildable area. Bob stated he liked the idea of a buffer and asked what would be a reasonable requirement. Teresa stated she can look at other communities and see what they do. John Klaers stated you need to consider what you want to mitigate noise, light, and would you prefer a natural buffer versus a man-made buffer. John stated it varies by property and what works for one may or may not work for another. John suggested we look at a commercial permit which would require a site plan that would address the uses on the property as well as parking and lighting and can be dealt with on a case by case basis. Pete stated he would be fine with 50% lot coverage for properties served by municipal services. Teresa stated we need to check how we define impervious surface so we take that into account on lot coverage. Bob stated we should define what we want as a buffer. Katie stated she would like to see us standardize things for interpretation purposes for us and for businesses for ease of use and she likes the idea of a commercial permit. Teresa stated it would be nice if the commission could look over the information she gave them so we can discuss it further at the next meeting.
Joint airport zoning board: Teresa stated the Duluth Airport Zoning Board of Adjustment met to hold a public hearing on a variance request. Teresa stated the minutes from that meeting are included in the packet. Teresa stated the next Joint Airport Zoning Board will be meeting on December 1st at 3:30.
Next Meeting Date: Steve stated the next Planning and Zoning meeting is Tuesday, October 18, 2016 at 6:00 pm.
Having nothing further to discuss, Biron made a motion with a second by Bob to adjourn the meeting. All vote in favor. Motion carried and the meeting was adjourned.
