MARCH COUNCIL MEETING MINUTES

March 27, 2017

 The meeting was called to order at 6:00 p.m. by Mayor Werner.  The Pledge of Allegiance was recited by those in attendance.  Present for the meeting: Mayor John Werner, Councilors John Goman, Greg Andrews, Suzanne Herstad, and Bob Quade, City Attorney Mike Couri, Clerk Joan Jauss, and Treasurer Holly Herstad.  Public attendance, list attached.

Greg made a motion to approve the consent agenda with a second by Suzanne.  All vote in favor.  Motion passed.

NEW BUSINESS:

Park Fertilization estimates for 2017: Joan stated that three estimates were received for fertilizing, weed control, grass seed, and aeration for all of the park fields:  Carlson Lawn & Landscaping for $3,250; Guardian Turf for $4,268.46; and Duluth Lawn Care for $2,635. It was noted Guardian and Carlson Lawn & Landscaping do not show aeriation in their proposals.  Greg made a motion to accept Duluth Lawn Care’s estimate for $2,635 with a second by Suzanne.  All vote in favor.  Motion passed.

Park soccer field rental agreement: Joan asked the Council if they wanted to increase the 2017 park soccer field agreement, the last increase was in 2012.  Council discussed and agreed on a $100 increase to the annual agreement. John G. made a motion to increase the annual rental to $1,900 with a second by Bob.  All vote in favor.  Motion passed.

AT&T meeting: Joan confirmed two councilors are meeting with MSA and AT&T on March 29 at the water tower to discuss removing AT&T’s equipment from the water tower while the tower is being painted.  John W and Greg said they will attend the meeting.

Draft resolution supporting local control: Joan received an e-mail from the League of Minnesota Cities with a sample resolution to be sent to our Legislators, giving support for local control due to the large volume of bills advancing at the Legislature that will interfere with local decision-making authority.  Many of the bills being proposed would move the authority to the state level.  John G. explained at the legislative conference he and Suzanne went to it was surprising how many bills are being considered by the Legislature that would restrict or remove local decision making.  Suzanne made a motion to approve the resolution with a second by John G.  All vote in favor.  Motion passed.

UNFINISHED BUSINESS:

Alcohol establishment safety inspections: John W. asked if he understood correctly that we are the only municipality doing inspections.  Joan stated that is correct, she informed Council it has recently come to our attention that we are not required to do the safety inspections when renewing liquor licenses.  Joan asked Council if they would like to continue to do the safety inspections.  Mike Couri said the City is not required to inspect the establishments, the City can continue to do without any extra liability.  Bob asked Jayme Heim what is included in the inspections that are done by the Health Inspector.  Jayme stated the Health Inspector inspects establishments that sell food and they cover many of the areas noted in the City’s inspection form except for the outside vegetation growth and disposal of trash. After much discussion, Greg made a motion to table the discussion until Joan can obtain a copy of the inspection report that is used by the Health Inspector before deciding with a second by Bob.  All vote in favor.  Motion passed.

Sunday off-sale liquor sales: Joan informed Council the hours for off-sale liquor sales in Ordinance #41 need to be changed to reflect the new Sunday off-sale legislation. Mike Couri stated, State Statute stipulates Sunday sales can occur between 11:00 am and 6:00 pm and City Council can reduce the hours but not extend.  Suzanne made a motion to keep with the State Statute of Sunday off-sale hours of 11:00 am to 6:00 pm with a second by John G.  All vote in favor.  Motion passed.
