PLANNING & ZONING COMMISSION
NOVEMBER 21, 2017
The meeting was called to order at 6:00 p.m. by Chair Steve Kossett. The Pledge of Allegiance was recited by those in attendance. Present for the meeting were Chair Kossett, Commission Members Katie Vukelich, Bob Whitmyer, John Hegstrom, and Kathy Meyer, Zoning Administrator Teresa Koivula, Deputy Clerk Toni Blomdahl, City Councilor Suzanne Herstad, and guests Greg Andrews. Bill Rosenbush, and Bob Quade.
Bob stated he was reading the minutes from last month and the motions that say approve changes as discussed is a little vague and he would like more details on the changes. Toni stated the changes will be presented at a public hearing but she will make note of his request. Katie asked if there was a way the Commission could see the changes to Ordinance #22 that they have approved so far. Teresa and Toni will work on getting the changes out to the Commission. Katie made a motion to approve the October 17, 2017 meeting minutes with a second by Steve. All vote in favor except for Bob and John who abstained as they were not at the October meeting.
BUSINESS FROM THE FLOOR: None
NEW BUSINESS: Teresa stated the Commission can add items to the agenda they would like to talk about. Greg stated the agenda should read “Old business” not “Unfinished business”. Toni will check into this matter. The Commission agreed to add a spot on the agenda which says “Any additions to agenda”.
Small Cell Technology Update: Teresa stated the State of Minnesota is telling us we need to have controls in place by January 1st allowing us to control small cell technology according to State Statute 237.162. Teresa stated Mike Couri, City Attorney is creating language for amending Ordinance #22 which the Commission will hold a public hearing at our December meeting to approve the amendments. Teresa stated the Council will handle the agreement and Right of Way changes that address small cell technology.
Proposed Buffer/Screening Performance Standards: Teresa presented the Commission with information on screening as found in our Comprehensive Plan and areas of Ordinance #22. Suzanne asked how we can apply this to currently zoned commercial property. Teresa stated they are grandfathered in so we can’t make them comply to new requirements unless the use changes or they construct new buildings or add on to existing buildings. Steve asked what would trigger the property owner needing to address a buffer zone. Teresa stated usually people come in to see what they can do on the property or some people come in for a building permit. Steve stated can’t we ask the property owner to submit a plan following our guidelines and we just make sure they meet the requirements. John asked what do we want the buffer to be. John stated we have different zones that will require different buffer plans such as between commercial and commercial uses. John stated we need to define what the buffer zone should be and the type of screening we would approve. Bob stated the definition of buffer notes visual but we also need to address sounds, smells, etc. Katie asked if this is to be applied to everyone or just uses abutting residential uses. The Commission agreed it should be commercial/industrial abutting residential not between every commercial and industrial use.
Nuisance Ordinance: Teresa showed the Commission a sample Nuisance Ordinance from the League of Minnesota Cities which would be in addition to our zoning ordinance. Teresa stated she checked other municipalities and they all seemed to be similar and the sample ordinance mirror state laws. John asked if this was just informational and a matter for City Council to approve. Teresa stated the Commission can look at it and approve it to send on to Council for final approval. John stated if Teresa thinks this nuisance ordinance would give her another tool to enforce issues, then we should proceed with it. Kathy asked if we can enforce this and can Teresa enforce it. Teresa stated it will depend on what is in the nuisance ordinance and it could be a combination of the sheriff and zoning. The Commission will look it over and discuss further.
Planning Commission Member Opening: Teresa stated we still have an opening on the Planning Commission and encouraged the Commission Members to spread the word.
Joint Airport Zoning Board (JAZB): Teresa stated the next scheduled meeting for JAZB will be Thursday, December 7th at 3:30 pm and there will be a meeting starting at 2:00 on that same day as an update to new legislation for Airport Zoning.
Next Meeting Date: Steve stated the next Planning and Zoning meeting is Tuesday, December 19, 2017 at 6:00 p.m.
Having nothing further to discuss, Bob made a motion to adjourn the meeting with a second by Kathy. All vote in favor. Motion carried and the meeting was adjourned.
