APRIL 17, 2018
The meeting was called to order at 6:00 p.m. by Chair Steve Kossett. The Pledge of Allegiance was recited by those in attendance. Present for the meeting were Chair Kossett, Commission Members Kathy Meyer and Bill Rosenbush, Zoning Administrator Teresa Koivula, Deputy Clerk Toni Blomdahl, City Councilor Suzanne Herstad who was a voting member tonight due to the number of Commission Members present, and guests Bob Quade and Greg Andrews.
Teresa stated she would like to add two things to the agenda, an email from Bob Whitmyer and an update on the state airport zoning bill. Suzanne made a motion to approve the agenda with the additions as noted with a second by Kathy. All vote in favor. Motion carried.
Bill made a motion to approve the March 20, 2018 meeting minutes with a second by Suzanne. All vote in favor. Motion carried.

Zoning Ordinance #22 Home Occupation/business revisions: Teresa provided the Commission with an updated Article VI, Section 27 Performance Standards for Home Occupations and Article V Land Use Controls. Teresa referenced Bob Whitmyer’s email and explained the difference between a Conditional Use Permit (CUP) and an Interim Use Permit (IUP) and noted with an IUP you can have an end date where a CUP runs with the land. Teresa stated Mike Couri, City Attorney noted we should have a list of allowable uses, so you can limit the uses you don’t want with the understanding you will be amending the list when people bring them forward. The Commission went over the proposed performance standards for home occupations and made a few changes to the proposal so as to not place too many restrictions on them as long as they do not adversely affect the residential neighborhood. The Commission also discussed the proposed definition for CUP and liked Teresa’s proposal. They also discussed the proposed definition for IUP and noted it needed more at the beginning of the definition, similar to CUP. Teresa will make the changes and present it to the Commission for approval. The Commission discussed Teresa’s proposed changes to signs for a home occupation reducing the allowable size and prohibiting illumination of signs. Suzanne and Steve agreed with the changes. A motion was made by Kathy to approve the proposed changes to Section 19.05 with a second by Bill. All vote in favor. Motion carried. The Commission reviewed Article V, Section 5.01 and the allowable uses list for home occupations. There was much discussion as to what uses to allow and the fact that the Commission could not foresee every use that would be requested. Teresa reiterated that Mike Couri said we can amend the list as needed. A motion was made by Bill to delete the allowable uses list and just note that home occupations shall comply with the performance standards with a second by Suzanne. All vote in favor. Motion carried. Teresa will make the changes as discussed and the Commission will continue its discussion on home businesses next month.
Joint Airport Zoning Board (JAZB): Steve stated the next JAZB meeting is on June 7, 2018. Teresa stated she received an email from MaryAnn with Duluth Airport Authority noting the airport state zoning bill was heard today and is included in the omnibus bill. Suzanne stated she meet with Senator Bakke and he asked if the airport zoning bill would be beneficial to us and she told him yes. Teresa stated if this bill passes, each community would be able to adjust the zoning to match their needs. Suzanne stated the trend is to have more local control instead at the state or federal level.
Next Meeting Date: Steve stated the next Planning and Zoning meeting is Tuesday, May 15, 2018 at 6:00 p.m.
Having nothing further to discuss, John made a motion to adjourn the meeting with a second by Steve. All vote in favor. Motion carried and the meeting was adjourned.
